FAQ — Refugee Claim Canada

Who can file a refugee claim in Canada?
Anyone who fears persecution in their country of origin due to race, religion, nationality, political opinion or membership in a particular social group can file a refugee claim in Canada.
What is the difference between a refugee and an asylum seeker?
An asylum seeker (claimant) is a person who has applied for refugee status but whose claim has not yet been decided. A recognized refugee is a person whose claim has been accepted by the IRB.
How does the IRB hearing work?
The RPD (Refugee Protection Division) hearing is like a simplified trial where the claimant presents their evidence of persecution. An immigration lawyer prepares the file and argues the case before the board member.
Can I work while waiting for my refugee claim to be processed?
Yes. Once your claim is filed and you have a work permit number, you can apply for an open work permit that allows you to work for any Canadian employer.
What happens if my refugee claim is refused?
You can appeal to the RAD (Refugee Appeal Division) within 15 days. If the RAD also refuses, you can request judicial review or apply for PRRA.
Is legal aid available for refugee claims?
Yes. Legal Aid Quebec covers refugee claims for people who meet income criteria. A lawyer can check your eligibility at the first meeting.
